✰In the arraignment court, before the judge, state ONLY
(a) "I am here by special appearance only"
(b) "I do not consent to, or concede to any of the charges"
(c) "NRS 171.010 has no statutory source in the statutes of Nevada, and therefore this court has no jurisdiction over any NRS including the NRS this court is charging me with."
✰Say nothing more! No matter what is asked, repeat the above, over and over if necessary
✰ The defendant is likely at this point to be rushed out of the courtroom and back into a cell. The court may take days to figure out what to do.
NRS 171.010 is the NRS entitled jurisdiction of offense committed in state and is the sole source of authority to enable the Nevada court to use the NRS's to charge, convict, and sentence a person with having violated any NRS
The problem with NRS 171.010 is that it is no statutory source in the statutes of Nevada, and this fact is evidence in the historical section of the NRS. (see memorandum in support of motion to correct illegal sentence; ground one, for details) and the Nevada supreme court, and Nevada court of appeals has repeatedly ruled that
(a)The NRS's are not the actual laws of Nevada
(b) The NRS's pursuant to NRS, 220.1703, are codified reference used as "evidence" of the law, and noting that the actual laws of Nevada are found in the (Statutes of Nevada) see Krig v State 125 Nev.1054, 281P.3D1193 unpub (2009 )WL1491110.
Because senate bill No.2 (1957) section 3 repealed all Nevada laws, (i.e. statutes of Nevada) prior to January 1957 at the enactment of the NRS scheme, there is no statutory source for NRS 171.010 which is (factually) evidence of nothing, and the Nevada courts lack jurisdiction over the NRS's to charge, convict, or sentence
[a] The NRS scheme was enacted by senate bill No.2 (1957) section 1 as the actual laws of Nevada. This fact is confirmed by assembly bill No.1(1957) and the Legislative Councils Preface pg2
[b] All laws of Nevada, in order to be binding on the people of Nevada, are required to have Nevada's enacting clause pursuant to Nevada's constitution article 4 §23 see(State v Rogers, 10 Nev.120 (1875) and Cain V Rogers, 10 Nev.120 (1875)
[c] Because the NRS individually are the creation of a commission and are not created by the Nevada legislative (noting that pursuant to Nevada Const. Art. 4 §1, only Nevadas elected legislative can make the actual laws of Nevada which are known as the Statutes of Nevada) consequently, no, NRS has the enacting clause
[d] When the Nevada Supreme Court was challenged with the NRS's is lacking the enacting clause, and that, consequently no NRS can be the actual law of Nevada, the Nevada Supreme Court ruled that the NRS's are not the actual laws of Nevada, but rather pursuant to the NRS 220.170 (3) then NRS's are merely evidence of the actual laws and are used as a codified reference of the actual laws, see (Krig v State, 125 Nevada 1054, 281 P.3D 1193 unpub 2009 WL149110)
[e] If the NRS's are not the actual laws, then senate bill No.2 1957 is incorrect and false, and must be struck down, which, consequently, would strike down the alleged and acting of the entire NRS scheme.
[f] if the NRS is the actual law of Nevada, then every NRS lacking the required enactment closure must be struck down, and this would strike down the entire NRS scheme (see Memorandum in Support of Motion to Correct illegal Sentence, ground two section 4 for details)
